Wardrobe Lifeline Services Agreement

Quick Summary:
Mobile emergency wardrobe stabilization for real-time Event Conditions. Services are temporary and non-structural. Liability is limited to $1,500 per garment and $3,000 per booking. 1. Parties & Representations

This Agreement is between The Finishing Stitch Concierge ("Provider") and the Client identified by the booking/payment information.

  • Age & Authority: Client warrants they are at least 18 years old (or legally capable) and authorized to repair the garments provided.

  • Valuables: Client is solely responsible for personal property at the location. Provider is not liable for loss or theft of items not involved in stabilization.

  • Consent: Payment constitutes full acceptance and serves as an electronic signature for immediate dispatch.

2. Scope and Nature of Services

  • Emergency Stabilization: Includes pinning, taping, temporary stitching, steaming, and pressing.

  • Limitations: Services are not permanent alterations or tailoring. Provider is under no obligation to restore garments to their original condition, achieve a pre-damage appearance, or ensure repairs are invisible; services are strictly limited to functional stabilization for temporary use. Provider does not guarantee garment functionality or structural integrity post-stabilization.

  • Professional Judgment: Provider reserves the right to decline or stop work if a repair risks further damage.

  • Prior Work: Any prior repairs or alterations by others may void claims.

3. Risks & Assumption of Liability

  • Fabric Fragility: Client acknowledges formalwear (silk, lace, tulle, etc.) reacts unpredictably to handling and heat. Emergency stabilization inherently involves manipulation of compromised materials, and resulting failure does not, by itself, indicate improper performance.

  • Presumption of Failure: Garment failure during service is presumed to result from pre-existing structural weakness or material fatigue unless gross negligence is proven as determined under applicable law.

  • No Bailment: Provider does not take garments "off-site." No custodial or bailment relationship is created.

  • Warranties: Provider disclaims all warranties, including implied warranties of merchantability or fitness for a particular purpose.

4. Declared-Value Requirement

Garments with a replacement value over $2,000 must be disclosed in writing prior to service.

  • If a garment's value is disclosed above $2,000, Provider reserves the right to: (a) require supplemental coverage or an increased liability cap in writing, (b) charge an additional fee, or (c) refuse service for that specific garment at Provider's sole discretion.

  • Failure to disclose a garment exceeding $2,000 in replacement value limits all remedies to the standard $1,500 per-garment cap.

5. Inspection & Documentation

  • Photos: Provider will photograph garments before, during, and after service. Photos are retained for 2 years; marketing use requires a separate opt-in.

  • Checklist: Client agrees to initial/sign a pre-service checklist. Refusal of photos or the checklist allows Provider to decline service.

6. Dispatch, Billing & Materials

  • Timestamped Dispatch: Provider will send a timestamped text message upon departure from the base of operations. This text serves as the official record of when billing begins.

  • Fees: The First Hour Fee is non-refundable once Provider is en route. Additional time is billed in 30-minute increments ($75). Client delays upon arrival do not pause billing.

  • Specialized Materials: Supplies costing more than $25 require Client approval (text/email) and are billed at cost plus handling.

  • Environment: Provider may terminate service without refund if conditions are unsafe, hostile, or unsuitable (e.g., inadequate lighting or harassment).

7. Remedies & Limitation of Liability

Provider’s total financial liability is strictly capped at $1,500 per garment and $3,000 per booking.

  • Provider’s Option: Provider shall, at its sole discretion, choose the exclusive remedy: (a) repair at Provider’s expense, (b) payment up to the cap, or (c) refund of the service fee.

  • Caps: If multiple claims exceed $3,000, payments will be reduced proportionally. These limits apply regardless of the number of claimants or garments.

  • Exclusions: Provider is not liable for consequential, incidental, or emotional damages.

8. Claims & Indemnification

  • 48-Hour Rule: Claims must be reported in writing with photos within 48 hours.

  • Inspection: Client must allow Provider to inspect the garment before any third-party repairs are attempted.

  • Indemnification: Client indemnifies Provider against claims arising from misrepresentation, ownership disputes, or third-party use of the garment.

9. Insurance & Subrogation

  • Primary Insurance: Client’s insurance is primary for garment loss.

  • Waiver: Client and their insurers waive subrogation rights against Provider for covered losses unless caused by gross negligence.

10. General Provisions

  • Verbal Statements: Verbal reassurances made during an emergency are situational and do not modify this Agreement.

  • Force Majeure: Provider is not liable for failures due to weather, traffic, illness, or venue restrictions.

  • GOVERNING LAW: This Agreement is governed by Nebraska law.

  • ARBITRATION: ANY DISPUTE ARISING OUT OF THIS AGREEMENT SHALL BE SETTLED BY BINDING ARBITRATION IN LANCASTER COUNTY, NEBRASKA. THIS IS A VOLUNTARY WAIVER OF THE RIGHT TO A JURY TRIAL. NOTWITHSTANDING THIS PROVISION, EITHER PARTY MAY FILE A CLAIM IN THE SMALL CLAIMS COURT OF LANCASTER COUNTY, NEBRASKA, IF THE DISPUTE FALLS WITHIN THE STATUTORY JURISDICTION OF THAT COURT.

  • Entire Agreement: This constitutes the entire agreement between parties.
